National Bioengineered Food Disclosure Standard

In order to stop a patchwork of contradictory state GMO labeling laws, in 2016 Congress established a national, uniform standard for identifying bioengineered foods. Pub. L. No. 114-216, 130 Stat. 834. Congress directed the U.S. Department of Agriculture (“USDA”) to develop the National Bioengineered Food Disclosure Standard (“the standard”).  USDA’s Agricultural Marketing Service finalized the standard on December 20, 2018, requiring food manufacturers and retailers to include mandatory, uniform disclosure for certain bioengineered foods and ingredients on food labels. All food manufacturers and retailers must be in compliance with the standard by January 1, 2022.
